You DO NOT restart ANY SOL by making a payment. If someone posted that on this site - they were mistaken. Many States have VERY specific rules about a consumer waiving their rights, Ca among them. The ONLY way a CC SOL can be reaged is if you enter into a new signed LEGAL contract with full disclosure of your waiving of your rights. Some few States do consider a signed check as a waiver of rights but that is only for a WRITTEN contract, and NEVER for a consumer agreement. The story of reaging of SOL by paying or even agreeing to pay is a MYTH fostered by CC companies. If your charge-off date was in 2001, your last payment to the OC would have been some 4-6 months BEFORE-- that is the start of your 4 year Ca SOL. If the CC was from a "pre-approved" or internet or telephone application, where you did not have to actually sign an application, your SOL in Ca is 2 years. Check your Experian report, see what the date is that they show for the account to come off. Deduct 7 years and 1 month from that date and you will have your start date for SOL.
