They can't go after my husband's income, at least not in a state that isn't community property. We file an injured spouse form with the taxes, and they don't take what it rightfully his refund. I have had no income for the last couple of years, so he has gotten his full refund back, even filing jointly. As far as I know, it's only 1 loan, but I did have to apply for each year, so I did get a loan for 2 years in a row. I don't know if this can be consolidated or not, but I was thinking about trying that. I don't think it's ever too late to get on some sort of payment plan, they just want you to pay it. I suppose it can be problem though, if you set up a repayment plan several times and failed with it each time. Even if you had filed for BK later than 1991, you wouldn't have been able to get rid of it; federal student loans are not dischargable in BK.
