Right, don't let these bums fool you with their meaningless nonsense about chargeoff dates. F.A. Management Solutions, a CA of Delray Beach Florida, whose operative is Attorney Hugh Brett Shafritz, represents before courts that the statute of limitations for lawsuits starts with the chargeoff date. Many CA's do this.
Knowledgeable attorneys will tell you that this is fraudulent on their part, as a collection attorney who speaks with clarity and authority on such matters is an expert in his field. They know better, thus is could constitute fraud before the court, according to attorneys for the good guys.
The chargeoff date as per FDIC regs generally commences 180 days following the date of default. This is defined as the date upon which the next payment due on account is missed. The date of default generally starts the statute.
Sleazebag collection lawyers who count upon defendant's unawareness of their rights and their fear of judicial process regularly exploit this for their own gain.
Another important point. CA lawyers substitute chargeoff date for date of default as means of 'running the statute' - a forbidden practice according to FTC regs. Beware of this also:
Let's say you miss a payment due in February, for example. Then you pay as required the March, APril, and May Payments, then you miss June and never make another payment. If you did not make up the minimum payment due in February, that is the date of default, not the missed June payment. Quite a difference in time - in your favor.
Collection lawyers, many of whom are proud graduates of Moms Mabley Night School of Gekko Repair and Legal Stuff make a practice of filing suits beyond the statutes. When caught, they routinely try to make their slopjob pigignorant cruel misuse of judicial process to be your fault. Don't let them.
Resistance is mounting to the whining credit card P.R. Spin artistes. A rotten economy has little tolerance for bullies in bankers' costumes. In good times, no one cares. When things are rough, your neighbor knows he could be next. Point is this - fight them back, hit them hard. That which they say and do to frighten you is also what these predators fear most.
Like the F-4 Phantom Jet pilots in Viet Nam, head straight for their missiles. Cost them money. Write the FTC and your State AG, nail them. Condition these CA bullies to associate your name with pain, expense, government trouble. It's the only thing bullies understand.
