I am in Michigan, A few months back they served a summons, and I called them to try to make payment arrangements. They agreed to $35 a month. They sent me a paper (This was a legal document for the court here)to sign agreeing to the payment. I missed a December payment, and was going to send out December and January together, but then I received a notice of garnishment from my employer the other day. He said he actually got it last week but didn't want to upset me then. I called the Lawyer listed on the papers, and they said that because I missed the December payment Capital One will not accept any other arrangements. I could have paid 1/3 of the amount to them right then but they would still garnish my wages they said. The only thing to stop it is payment in full. No I never went to court because I signed the payment arrangements agreement with them to try to settle out of court. I didn't realize this meant that if I got behind a payment they could do this. The papers I signed had to be sent to them and they filed them with the court. I figured I could pay the payment this month and they would have to serve me again before they could do this. I guess I didn't understand what I was signing.
