I'm not condoning anyone breaking the law but, the fact is the CA got the first punch in when they sued. It is your responsibility to answer the summons. Responding with a FDCPA violation is worthless. The judge won't even consider it unless you crossfile against the CA. Why would the CA settle unless you actually file the suit? Also, awards under the FDCPA are adjudicated. That means the judge will make the decision. I've seen many post with people suing for half a dozen or more violations and losing or getting $100 plus their filing fee. It's no slam dunk and I'd advise you to go to www.ftc.gov and really read the entire Act. Believe or not, Congress did make some defenses available to CA's. Good luck!
