It may be in January's archive, I think I answered a similar post on National Check Control. If not there, then it was in another forum I frequent. Anyway, is this for an old bounced check,perhaps ?

What state are you in ? First, threats of having your wife arrested to collect on a debt is ILLEGAL under the Fair Debt Collections Practices Act !! Go to www.ftc.gov, find the FDCPA and read it thru, so you know how to fight these slimeballs. Second, in most cases of bounced checks, there's nothing criminal involved, otherwise there'd be a LOT of people cramming the courts over bounced checks. Unless criminal fraud was being committed, a 'bad check' would, at best, be a misdemeanor. In most cases up to treble the amount of the check(s) can be collected and in some states an additional fine. Tell these moron collectors to 1 - cease and desist calling her at work; 2 - that they have already violated Section 807 (False or Misleading Representations) of the FDCPA. Chances are they've violated Section 806 as well (most of them do !) which is "Harassment or abuse". Quote the sections if you have to and tell them that you will file a complaint with the FTC against them and that you can sue them for their violations of the Act and recover $1000 plus damages from them !! Tell her to ignore their stupid threats and illegal demands. Give us a bit more information on the debt and we'll help you out here :)
