We are in Ohio and have dealt with Capital One charge off. Ours was for $3000 something. We got the charge off and 7 months later got a summons from a lawyer for Capital one(we have an answering machine so they couldnt talk to us. The card was in my husbands name and I was not down as authorizes user. If you get a summons and you dont send an answer letter through whomever it says they will automatically get a judgement against you and can put leins and garnish(for ohio) I see where you are in Texas and they cant garnish there. When we sent an answer letter back my husband wanted to try a settlement deal. I am not suggesting you do that,that is just what we did. When you send an answer letter,it will automattically take it to court. I was not impressed with the magistrate over our hearing. He had not even read everything and allowed Cap One lawyer to call on the phone and talk on speaker instead of appearing like we did. The magistrate said he would leave the room and we could talk about the settlement. After a few minutes of me saying what we wanted and them saying what they would go for,it pretty much satisfied us. They let us make $150.00 a month payments until paid off. We had asked for $125.00 a month payments and no interest. They wanted 29.40 apr . We settled for 10% interest apr. Im not saying you should do what we did,ask Why chat first and get his imput. Good luck,Oh yeh I forgot to say that the summons came certified letter.
