I was a teller for 4 years. If the check came back NSF (Non Sufficient Funds) and you withdrew the money prior to that knowledge and you have closed the acct. in GA you owe your bank that money back. It would be the same thing as if an ATM spit out money at you, you would owe that money back to the bank. Your bank might have been the ones to put that mark on your credit if your acct. is closed and it's been months since this happened. I would have to know if this happened weeks ago or months ago. The other parties bank CAN'T put any negative marks on your credit, it wasn't your check. It wouldn't be on checksystems, you didn't write/own the check. IF your bank put a hold on the checks it is the banks fault. A hold will be released when funds are available. You will probably have to go to court for the money from the person you sold your car to or repo it. Is Southwest YOUR bank or the other persons? A lesson to all...get a certified check, money order or you can call a bank and ask if funds are available and go cash the check at the bank the check is drawn on immediately.
