I have a card that I have had for five years. I was delinquint almost immediately but eventually got it caught up. Every few months I went delinquint again until in this last year, I just stopped paying altogether. Subsequently Discover has filed suit and is threatening with a judgement. Does the statute of limitations start from the time I was last delinquint, or from the time I was first delinquint? Where can I reference this law? The reason I am asking is because I live in Florida and the Staute of limitations is four years. The first time I was delinquint was over four years ago.
Furthermore, they stated that "I agreed to the resulting balance" and I "did not object to the staement" of account. I did no such thing. I read in earlier postings that this is illegal. What is your advice on these issues? E-mail me if you'd like or post on this site. Thank you.
