I'm usually wrong but the case I'm putting forth is the fact that if the down payment was accepted then a financial arrangement was made. Hence then the FDPCA would then be in effect and written notification is in fact required by it's regulation. The way around this would be if they had proof usually CRRR sent to your address on your original application even if it was known thet you was not there. Second if they do bill you for repossession from the down payment, then it is in fact a repossession wrongful or not. Way around this is to charge you an exorbiant mileage charge per mile and days that you had the car (like a rental) Let me know if I'm wrong again though, my girlfriend tells me that the one thing I'm consistent on is being wrong !
