MBNA did this ?? No mark-out.. and they sent you a letter stating the thing was settled ?? Well, then they will have a helluva hard time in court if W&A takes it that far. You've got the check without any rejection of the A&S/RE and a letter from the OC stating its settled. I'd fax a copy of that letter to W&A and tell them to piss off....
