What is the difference between the two? Which is the better way to go? I live in CA and am dealing with W&A thanks to MBNA. My check was sent 15 days after I sent a letter stating that I was settling the account for 11% of the remaining balance and that cashing the check closes the deal. I sent the check with an endorsement about something to the tune cashing this is payment in full. I have the original cashed check with the endorsment intact. Wachovia accepted the same deal. MBNA just sent me to Wolpoff & Abramson. Under CA law, shouldn't this hold up? How can I get W&A off my back? Do I have a case against W&A and what type of attorney do I need to talk to?
Thanks Burton
