CA filed a lawsuit and I demanded vailidation since I have never heard of this debt before and all I got was a signed credit card application and a statement with late charges. I had requested a list of items including CA's authority to collect the debt. Also,The creditor named in the complaint is different from the creditor name in the application and the amounts are different also. Will the judge accept this as validation??? What would be your opinion for a course of action? I am planning to file a motion to dismiss for lack of evidence..How do I file a counterclaim, they violated a slew of fdcpa and fcra rules.
