We need to know what State you're in ! 1 - They can't touch your husbands wages for any reason.
2- If all you make is $350 a month, then they probably can't garnish YOUR wages either ! 3- Is the original creditor calling ? If so, there's not a whole lot you can do to stop them because the FDCPA doesn't cover original creditors. If this is a collection agency, then you do something about it. 4 - IF they sue you and win a judgment, they'll find some way to make you pay it. Judgments will stay around a LONG time, usually a lot longer than the debt - depends on your state. If they can't garnish your wages now, they will wait until your income gets better and they CAN garnish (if allowed by your state laws). If you filed for bankruptcy last year, how on earth did you co-sign for a car loan ? When did you file and when was your discharge ??? You CAN petition to have your case re-opened and the forgotten debts added in.
At any rate a judgment on your credit report AFTER you've filed for bankruptcy will totally ruin your chances of rebuilding your credit and it poisons your 'fresh start' you should have gotten with your bankruptcy.
