Hey!

I had the post yesterday about a comlicated repo question. Thanks for your input and comments. Good news is I already have a copy of the bk. I think ex's attorney filled it out wrong.

See, the debts listed on the schedule F indicate all of the debts as joint. BUT...on the schedule H where it says to list co-buyers and other people responsible for these debts, it did not list anyone. I should have been on this page, according to the instructions.

My argument is: Since the debts were listed as joint but since I wasn't listed as a reposnsible party to the debts on the schedule H and since the creditors did not dispute this at the 341 meeting of the creditors, does this matter? I am just curious. It doesn't matter, since I was not a party to the bk anyways, but I was just wondering. I know that the contracts and obligations with these creditors is overridden by a bk filing. Since they did not dispute the filing after having reviewed all of the paperwork, including the fact that there are no other responsible parties for these specific joint debts, isn't this saing that they accepted the terms of the bk? It is an interesting question.

I have paid the things that are righfully due...even a couple of things he filed bk on...this repo thing is the only thing left.

Sent an intent letter to the cra reporting the bk. Will wait and see how their legal department handles it. Will wait to send them copies in the form of dicovery documents, lol. I am prepared to take this ALL the way for deletion.

What's your take on the bk thing? Thanks a BUNCH, whychat. Also, think I will try you medical collection letter. Will let you know if it works. Hey, I have an attorney here in my office that can review stuff...he reviewed my intent letter to make sure I didn't hang myself with my wording....if you need anyone to review letters and stuff, let me know. Of course, your stuff is so good, I'm sure you've got it covered! :)
