I am a single mother of three children. I have lived with my parents for the past three years. My divorce to my ex was final 2.5 years ago. I had a part-time job which I quit to have the third child and return to College. I graduated from Gwinnett Technical College in June 2001 with honors. I have an Associate Degree of Applied Technology with two majors: Computer Programming Specialist and Microcomputer Specialist. Unfortunatly, I have really bad timing. I can't find an entry-level IT job. My exes were paying child support which helped me keep up my credit card payments. However, they both haven't paid since April 2002 and October 2002. I received numerous calls from the collection department of my CC's. I explained that I did want to pay but I had no income and I was currently looking for a job. They said they would call back. Two weeks ago, I was delivered a suit notice via sheriff from Direct Merchants Bank and today I received a phone call from a Mr. Moore who works for Stewart & Associates informing me that he was hired by Capital One. When I explained my situation; he wasn't impressed. Anyway, the bottom line is that I have approximately 20,000 in debt that I have no way to pay. I have an 84 Monte Carlo SS that needs a carburator. An ex that owes 5000 in child support. An ex that owes 10,547.50 in child support, 10,000 in property settlement, and 900 in medical bills. I have recently been hired (contract) to develop an online course for the GCPS which will pay 2700. That is every "asset" that I have; except, for clothing, two toddler beds, one twin bed, one desk, three bookshelves, one alarm clock, bedding and a 19" color TV.
Can I file for a clean start bankruptcy? What about the two law suits that have been filed? Mr. Moore told me that since I don't have a case number as of yet, I can't stop the Capital One suit, so I will have to pay court cost, etc...
Help! I'm really freaking out. I have worked hard the past three plus years for my children as well as myself--please tell me there is a way out of this hole.
