I empathize with your situation.

My suggestion is that you file for bk. You will have a dirty slate, but a fresh start. You have your health and the health of your children to consider. The stress alone is not good for you and the children will see it no mater how hard you try to hide it. There is life after bk.

There are continual worries with judgements. Garnishment of future wages, if they will be renewed just when they are ready to come off. With a bk yes it is there for 10 yrs on your cr (actually 7yrs)but now a days potential creditors start allowing credit even 2-3 yrs after a bk.

Judgements are just as bad as a bk, but I think worse in more ways because of the continual haunting. Not to mention the stress of worrying.

You may have worries over potential jobs and how potential employers look at the bk. You have a valid reason for a bk with the child support. As long as you are honest with potential employers and have proof of the back child suport owed, I don't think you would have a problem.

If I were you I would see if my parents would lend you the money to file. When you get your $2700 pay them back with that. With the balance of that money treat your kids with something special (ice cream, McDonalds, or the new shoes that you haven't been able to afford) and find your self a lawyer to help you re-coop the back child support.

I wouldn't even look back, yes it is not morally right and not what we would like to do. But there are not many choices that are feasable. The OC's can right off the debt as well from the bk.

Please keep in mind this is strictly my opinion. There is light at the end of the tunnell. I wish lots of luck and stay strong for those kids and yourself; you will prevail. Look at what you have accomplished so far.
