What you have been told is false. They can start leagl proceedings the day you default if they choose. This is let's make a deal time. Call the lawyer and explain the situation and see if you can come to a payment arrangment for a reduced amount given you circumstances. Get it in writing that they won't pursue the court case as long as you pay as agreed.
You do not want a judgment on your credit report.
