In ohio,stopped payment on two more cards, have a question!

My husband is already paying $150.00 a month on one card we settled in court over(between husband and their attorney) magistrate left the room,returned when we were done. We have stopped paying nextcard 2 months ago,no charge off yet,and going to stop paying Aspire this month,due to the fact that the small payments are just making balance go higher.We decided to let them charge off before it goes much higher. My question is,can we request that the judge look at the income and decide if we can afford to pay those two also? Is there any kind of income guideline for things like this? We have many other bills.If we get a summons on these two,I will be back to ask for step by step help on how to handle them,hubby wanted to make a settlement offer with the other cards attorney,so we jumped in without alot of advise from you all. The magistrate allowed Cap.Ones attorney to stay in their office and negotiate over the phone,we appeared! The magistrate also had not even read everything by the time we got there. I will be better prepared if it happens again. We are in ohio,hubby has no assets,but does have a paycheck every week they could attach. He does not want that to happen! Cards are only hubbys,Im not authorized user. Thanks for advise!
