Somebody please tell me if we had the right to do this. The story goes: We had been sent a letter by CAMCO saying my husband owed a debt of $2400. When they called my husband answered and talked with them. He admitted having a debt from 14 years ago that was incurred because his ex-wife had failed to make the payments. They said the last payment was in 1995. They offered him a settlement amount of $1000 to clear it up but the offer was only good that day. They also had a copy of his credit report showing he had credit cards and what the limits were and tried to get him to pay it that way or electronic transfer dated for the end of January but we had to give them the information that day. The more questions we asked about it the madder they got and said "so you don't want to pay this debt". We told them if we made a settlement we had to have that in writing. They said they would send it the next week but the offer would not be good then because if we did not give them the information then they would send it on to collections to someone else for the full amount. They were very rude and at points hollering about it. Finally they submitted to sending a settlement letter to my email address. It stated: "Upon receiving your post dated check by 1/10/03 totaling $1000 as follow: 1000.00 dated for 1/31/03 and this payment clear as paid, your account will be settled in full and satisfied. Furthermore CAMCO will not place any derogatory remarks on your credit file." After we gave them the payment information we started to feel very uneasy about it and found this forum and Scott who posts here. He was very helpful. We immediately placed a stop payment on the transfer. The next day we started getting calls from CAMCO stating the account didn't verify. Were they trying to get the money then? The letter said it wouldn't be cashed for 3 weeks! Since then they have called me at work (which we stupidly gave them my work number). I told them I didn't know what they were talking about and wasn't even married or even know those people. It worked at first then they called back and called me a liar and said "Do you think we're dumb? We are going to pursue this bad check you wrote." I hung up. Now they are calling my parents and my husband's parents too. We have already drafted an C&D and SOL letter and are sending it this weekend. I have read on this site that you can stop payment when it has been obtained fraudulentally. We believe it has. Oh, by the way, they tried to slip a paper check through to the bank too and have been using a cell phone to catch us off-guard. We still are not answering. We want to file complaints but need to know if we are protected and can't be sued for a bad check.
Any help would be appreciated!
