I have a question. I was served with papers from lawyers representing a collection agency that was assigned my credit card account. I answered saying that I admit that I applied and was accepted for an account from the creditor but denied that I owed them any money. I also stated as an affirmative defense that the account was past the statute of limitations. It's been like 2 weeks since they received my answer and I haven't heard anything from them, not even anything from the court, like a court date. How long does it take to get a court date after answering a lawsuit? Can I hold out a small bit of hope that they may be considering dropping the lawsuit, since I didn't just roll over and let them get a default judgement? Or does it just take a long time to get things rolling? By the way, from what was included in the papers, it appears that they filed before the SOL was up. But, I think that their paperwork listed a less than honest date of delinquency but I have no proof. Is it possible that they really did fudge the date and think that I have proof and are backing off now? I know i am grasping at straws but, it's all that I have.
