There's no way to tell how long it will be or even IF they'll sue. A lot depends on how much you owe and whether or not they see assets or an income they can grab for. Personally, I'd wait a little bit before you send your settlement offer. If you look too eager, they'll jump all over you. I'd start with 30%, give yourself some negotiating room.

MBNA has probably just assigned the account to NCO. I'm dealing with the exact same scenario. In many states, CA's have no standing in court anyway, so the OC has do do the suing. IF they really did sell the account, then NCO could possibly sue.
