Whychat, I have already sent in my answers to a complaint with affirmative defenses. I think I might have one more that I di not list in the answer and that is SOL. The only evidence I have is a Credit Report that gives charge off date. Work back 180 days and bingo, it's past SOL. Will the judge accept this? i have asked the CA and their attorney to provide me the date of last payment and of course, they have not complied. Also, I have a copy of the account statement from the CA that I got during DV and all it has it late and finance charges. Doing a simple time value of money and NPV calculation on the past due balance, I can exactly tell them when the last payment was and this matches the CR. Is this too complicated? Also, can I introduce this during the trial as a motion? Thanks
