col. agncy called me back

i had a run in w/ calvary inv last month. long story shrt, they are trying to coll. on a debt on my hubby from a ch. act w/ ex from 1995.(date opened). called today asking where pymnt was. i told them that we sought legal council and that we are requesting info on act, copy of original portfolio, etc. he put me on hold so i could talk to "supervisor". the same guy came back on and said, you handle things on your end, ill handle things on my end and go from there. then he started giving me crap because he claims he sent me info, that i never recd. told him the fair coll. act says he has to send me written notice in 5 days, then he got nasty said he was done messing around and was gonna do what he has to do and hung up. he confirmed my address so i know they have it, and he also said that it was charged off in 98. but the credit report i have said date opened and dola is in 10/95 and the date reported is 4/98. so, is the date of last act. the date that begins the sol (scott was kind enough help me get sol info)is there more i should do to get more info from them, and if they were to try to get a judgemnt, wouldnt they have to serve us something and wouldnt that mean someone would have to physically give it to me, i dont want action being taken without our knowing, and have a jugemnt by default ordered. can that happen?
