Ok this is what you do but it does delay your return by about a month or 2. When you pick up the tax papers there will be a sheet for an 'injured spouse'. You fill out it and send with your tax returns. It will have you list each income for each person and they will manually figure out how much you would have gotten back and send you out a check for that amount. I owe for student loans and we fill one out every year and in late april or so we usually get a check that goes with my wife's income.
