honestly im far from an expert but yes Kentucky does allow garnishment of 25 % of a total paycheck but no more than that .. the Statue of limitations for credit card debt is 5 yrs there so seems like your well within statue so thats not going to help you anytime soon .. unfortunately if you own a home reguardless if its paid for or not IN MY OPINION YES they most likely would sue you becouse they go after assets & thats very obtainable for them so if they sue & win a judgement they'll probably place a lein on the home & once you sell it whether in 2 yrs or 15 yrs they'll get their money from the lein once the home is sold .. i dont wanna tell you what you should do becouse like i say im no expert AND i dont know of your EXACT situation but IF thats the only card your having troubles with & you still have it id do like observer suggests & pay it off BUT if having severe credit troubles id talk to a BK attorney & possibly file BK but like i say THATS ONLY IF your in a very bad position & i dont feel owing 1 card is a bad position .. like i say this is only my opinion & its what ID DO IF in your situation .. ive personally never had a capitol one account but their really no better than the rest becouse 1 hint of trouble they than feel they gotcha , its sad really so trust me i dont feel bad for capitol one at all .. hope i helped a little & sorry i couldnt be of more help , bye kelly ......
