Unless you're going to court, its rarely too late to demand validation, the FDCPA says you can request validation at ANY time. Though from what I've read, W&A don't and won't validate. However, having proof that you made the request is a good thing. Do you have any idea why they claim you requested the C&D ?? They often will say that if you fight them at all, make them produce proof of your so-called 'request'. I'd send them your offer again, change it a bit if you have to, stating that you are rejecting their terms and unless they can agree to at least some of yours, you're not paying them a red cent. I'd also point out, and make photocopies with highlighting, that their 'offer' was dated 2 days AFTER their supposed 'deadline', so they were pulling a scam on your to start with. If they're still calling you, then send the C&D and limit them to mail contact only.
