Whether an affirmative defense, motion to dismiss, summary judgment, etc.. has been made, it will not affect how to respond to Requests for Admission or other Discovery Requests.

If Request for Admission are made, they have to be responded to or they will be deemed admitted. Period.

If you deny them, you have to do so with a good faith basis. Otherwise you face sanctions.

Not knowing what your case is about, let me say this in a general sense. If you are sued on a debt that is validly yours, and a request for admission is made on whether you owe this debt to the plaintiff, you better have a good reason why you don't owe it to them if you want to deny it. Not that this is involved in the case at hand. I'm just saying...
