Direct Merchant's Bank and charge-off

I am recently going through a divorce, and owe this creditor quite a bit (thanks to the soon-to-be-ex. I previously went thru debt mgmt, but there was a rejected proposal, and they were not paid thru the debt mgmt co. Then, they called me last November and supposedly set me up on a "promotional" program, whatever that is. They did an auto withdraw in November with my authorization. I then stopped the auto-draws. Now I'm using another debt mgmt agency. Direct Merchants have rejected their proposal, say I'm not eligible for it until December 2003, and were calling me twice weekly. The new debt mgmt co sent them a payment last month, which they accepted, but called me AT WORK (not the 1st time) and told me they were charging off the account, and that I needed to be making payments directly to them rather than through the debt mgmt co.

Can Direct Merchant's do this? I thought as long as they had received a payment that they couldn't send it to charge-off. Even though the proposal has been rejected, the debt mgmt co has still agreed to send them payments. Is there anything I can do at this point? Has anyone else had problems with this creditor. A friend of mine told me she filed bankruptcy after they did the same thing to her.
