I went to a Pretrial Conference today in a FL County Court. It was not what I expected. A lot of the names called didn't show up and I heard 2 lawyers sitting in back of me talking about how 60 to 70% of their defendants don't appear. (-So getting default judgements here must be like shooting fish in a barrel.) The judge rushed everything, he told us that we would have the opportunity to say approximately 2 sentences on our behalf. His first question to me was "When do you plan to pay this debt?". I replied that it was not my debt. The CA lawyer said that it was a CitiBank card. (-at least I know now who the OC is!) I told the lawyer to send me proof that this debt is mine because I've had someone with the same name appear on my CR in the past. -That was it! -So what happens now? I feel frustrated that I didn't get to defend myself. -Will the lawyer really send me validation of the debt or should I send a request to the Law office requesting validation now? -Or do I send it directly to the CA? -Will this definitely go to court? -Any idea? I never had any communication from the CA or the lawyer until they served the summons. The lawyer claimed that I was sent a letter (-a bill attached to the complaint) but I never was. The amount is under $5,000 so they used small claims rules to file. -Can you imagine what that will balloon to when they add on extra interest, lawyer's fees, etc? I own a homesteaded condo and no car. I have no savings or investments and take home only $129 a week from my part-time job. -So I would never be able to pay them if they ever got a judgement. I'm just wondering what the next step will be.
