I was sued a couple of months ago from a bank that financed a car I had. They repoed it almost 2 years ago and just now are suing me. I responded to the court with a written letter explaining that I was never notified of the remaining balance or given the opportunity to repay my debt before being sued. I also wrote the bank a letter and offered a cash settlement which they declined to accept. This week I recieved a certi8fied letter from their law office that is a request for a summary judgement. My question is where do I go from here? I own property in the county I'm being sued (homestead) and rental property in another county. Can I be forced to sell my rental property? Is it safe from judgement since it is in another county? Or will I have to pay the judgement if I want where to sell the property in a few years? Also, my loan says I cant owner finance the property, but can I put the house in another family members name and still be responsible for the property myself? (Like a gift without warranty?) please help?????
