A request for a summary judgment is normally a request for dismissal of the case.

Are you sure you received a request for summary judgment? Does it ask for YOUR signature? If so, your letter to them advising them that any deficiency claim is invalid because of lack of notice on the repo, has caused them to withdraw their claim.

Tx. has VERY strong laws and penalties in this area, if they had proceeded they could be sued for the entire amount of the repo'd car + costs and fines.
