I've been here before asking questions about this subject. And appericaite all that have taken the time to reply. I think perhaps, I may not have correctly stated it. Or just need some advice.
(13 years past/C0-Signed/Being Sued)
I co-signed for my husbands truck in the state of VA.
We divorced. He and the truck moved to Ohio. I moved back to Wisconsin.
I made the dumb mistake of taking the call from the
"Finance Company" of out Norfolk, Va.
They now have my phone number and correct addy. And sent me a copy of the "Promissory Note and Securtiy Agreement"
I told her the SOL was way out of date. She snottly replied, NO it's not, It's 15 years in OHIO.
I just said, I'd have to talk to my attorney. She asked IF I was going to file Bankruptcy?!!
I just replied, I'll talk to my laywer.
About 3 weeks passed. I noticed the sheriff's car and did not answer the knock at my door today. I assume he was going to serve me papers. I'm on medical leave right now, so he will probably catch me at work when I return on next monday....
Do I need to file Bankruptcy before I go to trial over this in order for my paycheck not to be garnished? Any idea's how much bankruptcy may cost in the state of WI? (like a grand or under?)
In a reply to this subject before, it was mentioned that the vechile would be covered under the Ohio's 4 year Sale of goods SOL...I am niave on this, but it sounds like the 'goods' would have to be bought in Ohio? Could the SOL be factored in on a situation like this>perhaps I need to know what this actually covers?
Even though the vechile loan was signed in Va, and the ex has let it go sour since april of 95 in the state of OHIO and they are trying to summons me to court in the state of Wisconsin, going by Ohio's SOL.
Could there by a backbone to this? If not, why would they try to take me to court if there are any laws that could protect me?
Through some of the other mentioned posts, I am picking up on that perhaps, they may have a leg to stand on, since it went sour in Ohio and me being co-signer-would be bound by Ohio's 15 year SOL??
