Thanks! I just typed up a letter and am on my way to mail it. I'll wait and see if they accept. Considering the problems FCNB is having you would think having a delinquent account paid in full in four months would be acceptable. We'll see.

I'm wondering what the below statement "present a statement" means. It would be nice if I could say I'll pay the darn thing at my stated terms so there is no need for court.

The summons states (edited): You are required to file or present an answer to this claim within 30 days after service of claim upon you. If you do not answer, judgement by default will be entered against you. Your answer may be filed in writing or may be given orally....if you admit the claim but desire additional time to pay, you must come to the hearing in person and state the circumstances.....you may come with or without an attorney.

I called the Magistrates Office and they were out to lunch so I'll try later and find out if I can go for my husband.
