My husband and I were unable to pay some debts because we went back to school and didn't have any money. We were not married at the time we incurred these credit card debts (we got the credit cards and incurred the debts in California). We got married, moved to NYC, and I got a letter from from an attorney's office (Eskanos and Adler). They agreed to a settlement, they sent me a fax stating that "this letter confirms that we have agreed to settle the above referenced obligation for the sum of $1,600 on condition that the said amount is received in our office in good funds by the date indicated below. If this amount is not received, then this settlement will be null and void and the full balance on the account will be due and payable". I gave them my check numbers over the phone, and have not heard back from them, even though the amount has been withdrawn. Does this mean that the remaining balance on the account before the settlement can be sold to someone else?

My second question is, now that I paid that, other creditors are calling. There is one in particular, Pacific Coast Collections, whom I spoke to yesterday that concerns me. The debt they bought is under my husband's name, but they immediately told me that my husband owed them money, how much, etc. I told them that all communication should be done in writing, and secondly, that they were violating Federal Law for discussing the debt with someone other than the person on the account. He got angry, said that by New York law, he could discuss it with the spouse, and that if I didn't agree to a settlement, he would call him at work. I told him that he could not call him at work, and he said he could do anything he wanted. I asked to talk to his supervisor, and the supervisor tried to get me to say that I was not going to willingly pay this debt... I didn't say anything, other than "you are violating federal law by discussing this debt with me, and you are being told not to call my husband office", and he said that his next action would be to call my husband's HR office because he knew where he worked, would garnish his wages, and that he would recommend to his client that suing would be the only option, and that he did not need to follow federal law, because he was following NY state law. I have filed a complaint with the FTC, and have sent a debt dispute letter, along with a cease communications letter to these people.

Here are my questions: what sort of information do they need to provide that will validate the debt? Once they provide whatever documents they need to provide, should I tell them that I only deal with the original creditor?

When the other creditors start calling (which I'm sure they will once they see that we're starting to pay off our debts), I will tell them not to call me again and I will send a cease comm letter. However, I ultimately want to pay the debt but not all the ridiculous over the limit and late payment fees. How can I do that? Do I need to only deal with the original creditor? What sort of letter can I send to agree to a settlement and persuade them to report it to the credit bureaus as paid as opposed to settled? How can I settle with them, and make sure that the remaining balance isn't sold off to someone else? What letters can I send to the credit bureaus to get them to get those accounts off sooner? Ultimately, what have you heard about a person called Bud Hibbs who offers advice, and services so that you won't have to deal with creditors? THANK YOU! (I'm sorry for the long post!)
