Your situation is WAY beyond the scope of a CONSUMER credit forum,none of the Federal consumer protection laws apply to business debts. Ca. DOES have some protection for you if you are being harrassed, but that is not the problem.

Your lawyer should try to get this straightened out,or you should get another lawyer.I do not know if your husband's assets can be reached, as Ca is a community property State,and I do not know what the partnership agreement you had says about the status of your interest,nor do I know what the loan agreement said.

You MIGHT have been able to keep from getting sued IF the loan had defaulted over 4 years ago,but that is not the case.

I cannot help you, it looks to me as though the bank is not at fault,unless you can PROVE they knew that documents were forged.

The fact that the business was PAYING on this loan for over 6 years without you taking any legal action against your ex partner or the bank does not help you.

See if your lawyer can negotiate a settlement.
