Whychat, hear me out,please.

To summarize an earlier post concernig SOL,UCC and a repo.

When asked if I can sue using UCC and statement of accounts you answered "NO" it has to be active, and I believe you.

however, I am looking at this at a different angle.

On at least 1 credit report they still show a balance due and even sent me an email suggesting the status on my report will not change unless we come to a settlement(meanwhile sending me no proof of the account ever existed nor sending proof that the repo was done legally)..

Is it possible this still may be considered "active" even though the vehicle has been gone 5 years?

I am thinking (and probably incorrectly) that if they are listing a balance and "possibly" trying to collect a balance that I have "cause of action" when I saw this on my report and asked them for accounting statement concerning how they arrived at the balance.

Again, i am probably wrong but thought maybe I'd approach it from a slightly different angle and see what you think.
