Unfortunately, without reading the entire case, no one can argue for or against, and it is difficult to take those few sentences literally, and out of context, and apply them ot an individual's situation here.

You remind me of some other folks who have come on other boards and said "caselaw, caselaw, caselaw" knowing that those posting on the board do not have access to the expensive legal services from which you obtain your information, and so you could, of course win every argument, without actually proving that the caselaw you cited was interpreted correctly, and was relevant to the consumer's situation. I see these are all corporations involved in these cases.

To my mind, that immediately connotes a difference in interpretation. consumers and businesses are not subject to the same interpretations and case law.

My other question is, why would an attorney be spending all this time discussing caselaw on a website like this? You could be working on your cases. ;)
