With any possible suit you have to prove to a judge that you gave them every chance to settle the issue. A phone call will not do it. Did you send anything out certified asking them to immediately delete the inquiry and negative info? If you did not then you need to do it right away. Give them 30 days. Then file with your attorney general, theirs, or both. Follow up with a complaint with the bbb. I just filed against a CA. I actually gave them 7 months. Now when I go to court I can show the AG complaint they ignored or the dozen faxes they ignored.
