I have the same question, why can't you file for bankruptcy yourself ? You don't need to divorce for that. Yes, TX is a community property state, but I don't believe that would have the impact on your husband that I'm guessing you think it would. You're really not 'screwed' by being in TX, you're actually in a pretty good place. Your home is 100% exempt, the exemptions against judgment are generous, and they can't garnish your wages. Yes, they can levy the bank account, but first they have to find it - and they'll do that thru interrogatories if they don't already have that info. If you've got bill money in there, I suggest you get it out of there ASAP if they already have your bank info.
