Right,WhyChat is a fount of truths abundant. Your partnership is protected. If you are head of household your pay cannot be garnished. As to the partnership, only 'distributions' can be glommed by some scumbag CA, if they are sufficiently stupid to get an attachment to it. Easy cure - general partner declares that no further distributions will be made, they are out of chances to get money but still are eligible for their share of the taxes to IRS from the phantom profits of the partnership.
Meantime, the partnership can surely be written so as to make reasonable payments for various necessities. A good attorney can guide you, perhaps even an Enrolled Agent Accountant would be a better choice. BK lawyers specialize in BK, the perspective of an accountant is always good.
It is horrifying, nerve wracking, destructive on a good day to wait out these suit-flies and the SOL, thus BK is indeed a fine and worthy option.
On the other hand, sometimes when you answer a civil suit - and these will be civil and thankfully not small claims - suits, by pleading that you 'lack knowledge' to each count, these plop-worms move on to next target of opportunity. These vomit-bunnies have to slug it out with you in court. But you can start with complaints to the FTC, FL Banking Div, BBB, even the newspaper.
After all, you are considered as disabled. Now, the FTC prohibits CA's from engaging in practices detrimental to health of healthy persons. But the disabled? Oh, mee oh my oh, you have a fine opportunity to make the 'lives', in the loose sense of the word, of these parasites most interesting.
Write them up, tape their calls and care not on whit about the stupid two-party consent taping law in Florida. At least that's what some FTC investigators will tell you.
They have to play by court rules. But you are free to gambol joyfully in arenas forbidden to them, places in which you can along with other dutiful complaint writers, inject these syphillitic cretins with the slow poison of justice richly deserved.
