What do you mean by "negotiations"? Are you talking about a negotiated settlement, or a stipulated, (mediated) cxourt authorized settlement? If you are trying to avoid getting a judgment filed against you, your best bet is to appear at the hearing and contest it. If you are within SOL, and the CA who has filed suit has ALL the required proof of the account, then you can "settle" during mediation. This means agreeing to pay X $$ on a regular basis for a period of time, if you fail to pay, the judgment is entered against you. If they have actually filed suit, and you have been served with papers, then entering an answer,appearing at the hearing and disputing the amount or extra charges will give you some leverage. We have had this thread ongoing with you before, and I STILL believe you are beyond SOL, if you are, why in the world would you wish to "settle" and risk a sneak default judgment and ongoing grief when all you have to do is show up and get them to prove it is not a time-barred claim.
