I talked to an attourney (I live in VA ) He advised meto pay the amount of the check plus the bounced check fee (In virginia $25.00) and notify them that I am disputing the remaining balance. He said also to include a cease and desist with the letter so they can not contact you.(at least you can tell them not to call you) He told me that as long as the amount of the check was paid that there would be no basis for criminal charges. go to the FTC homepage ftc.gov I think. You can read the Fair Debt Collection Practices Act and maybe get another idea. Make sure you make copies of everything and send it to them via certified mail so if they do try to press legal action you can show the judge that you disputed the remaining balance. (I used to work as a bill collector, and we wouldnt take somone to court for anything under $500. Even still we had to get approval from the company that hired us to collect the debt.) P.S Laws in your state may be different than in VA. Im sure you could always just call an attourney in your area, most will offer a free consultation.
