You answered my post down below, and I was afraid if I posted back down that far, it would get lost, so I just posted a new one now. I asked about fending off my creditors for another 3 years so I could file BK (I filed BK in 2000). I owe about $5,000 in credit card debt. My creditors are Cap One, Providian, & Cross Country. All cc payments are 90 days past due and are being referred to a CA for collection. I'm not trying to get out of paying them, but when I called a couple of months ago to try to set up a payment schedule, they want more than I can afford. Meanwhile, they tack on the late fee and the over the limit fee, so my payment does NOTHING to the balance owed. That's why I just quit paying. I know it sounds terrible that I'm just trying to hold out long enought to file BK AGAIN after just filing in 2000. I had cancer and no insurance, so my BK in 2000 was STRICTLY all medical bills. Now, I need to file on my credit cards. I got in over my head with the credit cards when I bought a house last year that had over $17,000 in black mold damage. I couldn't live there because my daughter is highly allergic to the mold. Remember me? I posted questions about the house too. Anyway, the house deal is done. They accepted a deed in lieu, but meanwhile, I was trying to pay rent and a mortgage AND astronomical attorney fees relating to the house, and my credit cards were run up. I pay all of my other bills such as car payment, rent, utilites, student loan, etc. But, when I have to choose, my credit card payment is the very last thing to get paid. If I could borrow from my 401K to pay off these credit card debts, would I benefit at all? Would my credit score improve at all? (I'm in Indiana) Thanks so much for any advice!
