Here's my problem... as short as possible.... May of 2002 we enrolled in a DMP (debt management program). 08/24/02 and 08/30/02 I received letters from Gulf State Credit demanding that I pay on a Capital One Card. 09/09/02 I responded in writing regarding the DMP and asked that they verify this information and I copied this letter to Capital One. I heard nothing else from them regarding this card. I had a phone conversation with Capital One regarding another Capital One account on 02/24/03 and found out that this particular card had not been enrolled in the DMP and had not been receiving payments. They told me that I would need to contact O.S.I. 02/26/03 I sent a letter to the last address that I had which was Gulf State Credit in Jacksonville, FL. It was returned to me marked "Return to Sender Unable to Forward." I made several attempts to call them to get new address. Finally got a new address and sent another letter on 03/14/03 to O.S.I. in Doraville, GA, explaining what had happened, agreeing to make payments on the debt, and requesting a statement showing balance and transactions posted to the account. (And sent payments to Capital One on this account during that time.) 04/01/03, 04/11/03, 04/14/03 letters were sent requesting the same. None of my correspondence has ever been responded to. On 04/24/03 I called O.S.I. and was transferred to Miguel in their litigation dept. I asked him for a statement and he told me that "it wasn't his job" and that he was to "prepare paperwork for attorneys." I have been trying to research my rights as a consumer as to their failure to communicate with me and what I feel is an attempt to conceal my statement. Can anyone point me in the right direction? I would prefer to correct this situation without contacting the FTC if at all possible but will if it is needed.
