I suggest you file an answer with the Court and a copy to the lawyer, denying their claim in it's entirety. DO NOT in your answer make ANY reference to your insurance paying, or not being billed. Say as LITTLE as possible.Just refer to the case # and court #.

At the SAME time, send the letter to HC providers from my website. Use insert"b".

Send this to the legal Dept. of the Hospital.
Where the "collection agency" is referenced use the name of the lawyer who has filed suit. Where the reference to credit reports is, replace that with the information of the filed docket #.

DO NOT send this 2nd letter(HIPAA) to the "collection lawyer".Send it to the LEGAL DEPT. of the Hospital, DO NOT send the collection lawyer a copy. Do not communicate with the collection lawyer other than your answer denying the claim. MAKE SURE you do not in ANY WAY in your filed response to the Court and collection lawyer refer to anything about the date of service or even the name of the hospital.THAT IS ALL PRIVATE HEALTH DATA.
