old electric bill and CA

Hi! For some reason I had trouble posting yesterday. I read in previous posts when there was trouble posting to go to Creditboards.com. I posted my problem there. I almost felt like a tradior. lol You all are terrific.

Here is my situation:
Thanks in advance. I think I really messed this up. I am planning on filing BK in the very near future. There is however an old electric bill in collectioin agency in both my mother's and my name. I need to take care of this bill because my mom is going to try and refinance her home. If it was just me I would include it in the BK.

The bill is from 1999. They claimed I owe 762.00. Before I called the agency I called the Electric Company. They told me all the paperwork/info had been sent to the CA. I did not feel this amount was right. I wanted to be sure that it was disconnected in6/99 when I called to have the service taken out of our names.

I have NEVER recieved a collection notice from these people. I found it on my credit report.

Fine, so I called the agency. Talked to a thug there. I asked a few questions about the charges and wanted her to verify the date it disconnected. She told me that they had NO paperwork. The electric co had it they lied. Fine. tried to make arragements to paythis off. I told her several time that the amount was just to high. I could not be right.

I happen to find an old electric bill that was 2 months before the cut off. It was 281.00 I knew something was wrong. I called back to tell her this. She got nasty nasty nasty..I asked to speak w/supervisor. We worked out the 281.00 plus 2 months usage based on what was on my bill. Came to 413.00. I was happy with that 260.00 billing error. I told him I wanted him to send me a letter to the agreement. He told em no problem he would get it writtenup.

I got a letter today reminding me that 50.00 was due by the end of the month. WAIT. I never agreed to anything this month.

I called them back. The new thug on the phone was a piece of work. He told me that I never spoke w/supervisor. He could only make a "settlement" with me if I paid today. I told him I was not SETTLING anything I was going to pay the correct amount only.. (I have the bill. I have proof.) He told me that if I paid this he would send me a letter within 30 days so I could have the Credit Reports changed. I laid into him on that one. This guy talked such circles...OMG
He told me to call him back when I reached my decision.

He called me back within two hours. Was I supposed to call you back? I told him no. He asked if I made my decision....I said no. He told me that He would expect my call by Friday. I told him that I was sending a letter to his agency I would not be calling.

I did this so wrong. But, I thought I was going to be paying the correct full amount until I happen to find this old bill. Even trying to establish a Monthy usage from my old bill bothered me. I am just looking to get this paid off for my mom.

If this is from 1999 it will be 4 yrs in june. Is electric service covered under the UCC for goods and services? This is from the state of IL. Just wondering if SOL could be a bargining tool.

Also, I am not quite sure what kind of letter to send to them. I am thinking along the lines of validating/Dispute the charges having them provide the paperwork which they can't. I MUST pay this...but I don't want to be paying for something I did not use. I would appreciate any suggestions.

These people are slimeball thugs from the sleezy part of chicago!!!

I am going to send the validation letter. However, I can't understand the SOL on this type of bill. I would appreciate any help. aby
