I know I was primary on the account, but the bank states our account is set up as "and/or" Would that affect the primary status? Wouldn't a lawyer cost me more than the $146.71 they garnished? My husband is the one being garnished. I am not listed anywhere in the papers. They tried garnishing his wages, but we threatened to take it to court to prove it would be a hardship and the attorney, I guess, decided he did not want to drive to the city we are in and decided on a payment plan. We sent 150 dollars two months in a row requesting something signed by the attorney stating the agreement made. He did send my husbands employer a letter stating that the garnishment was off. And he was suppose to send the same thing to the courts. He never sent us a letter stating the terms of the agreement, instead he sent a letter, with someone else's name than my husbands, but with my husbands information on it. The letter basically was for my husband to sign stating he accepted the entire debt and would make payments. I would not let my husband sign and we called the attorney, but he would not return our calls. This was last December. And now he goes for the checking account. The five years on the judgment will be up in November, if the attorney forgets to renew. It was a default judgement.
