I purchased a car in 96 - it was repo'd in 97. The car was sold at auction and there was a balance remaining. Skip now to 2003. I have a collection agency that contacted me about the deficiency balance. They put a NEW charge off on my Credit Report for the def. balance. I was denied credit recently due to this new chargeoff. I thought the SOL in Texas was four years and the orig. debt would be removed from my credit report. Is this legal that this collection agency put a fresh chargeoff on my credit report? What can I do to get this removed from my credit report? Can I sue this Collection Agency? What are my rights?
