You can sue anyone you want to. The best advice for that is to make a complaint with the Federal Trade Commission. www.ftc.gov

If I were in this situation I would.

1. Write a letter to the to credit bureau that is reporting the del. and dispute the acct. They are required to remove such items within 30 days if the CA is not able to corroberate their collection item. In this case sounds like the CA has been retained via electronic info transfer. Very few CA's these days carry support documentation prior to their retainment.
